1. Introduction
These Terms and Conditions ("Terms") govern your use of the website, mobile applications, booking systems, and related services operated by Xiao Qiang Holidays Sdn Bhd (Company Registration No. 201301017811), trading as XQ Attractions ("the Company", "we", "us", or "our").
By creating an account, submitting a booking, making payment, or otherwise using our services, you ("the Customer", "you", or "your") confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.
These Terms apply to website transactions for attraction tickets and island activities. Product eligibility, visit rules, and change or refund treatment for a specific booking follow the purchased product's terms as shown at checkout and in your confirmation.
2. Definitions
In these Terms, the following definitions apply:
- "Company" means Xiao Qiang Holidays Sdn Bhd, including its subsidiaries, affiliates, officers, employees, agents, and contractors.
- "Customer" means any person or entity accessing the Platform, making a booking, or using any service provided by the Company.
- "Product" means any attraction ticket, island activity, tour package, or related experience offered for sale on the Platform.
- "Booking" means any reservation submitted through the Platform, whether confirmed, pending, or rejected.
- "Platform" means the Company's website, booking systems, applications, communication channels, and related infrastructure.
- "Visit Date" means the date (and session time, where applicable) selected for redemption or participation as stated in the booking confirmation.
3. Eligibility
By making a booking, you represent and warrant that:
- You have legal capacity to enter into binding agreements.
- You meet any age, height, health, or other eligibility rules stated for the Product.
- All information you submit is true, accurate, current, and complete.
- You will comply with attraction operator rules and local laws at the Visit Date.
Where a Product has special eligibility requirements, those Product terms prevail. The Company may refuse or cancel a booking if eligibility cannot be verified.
4. Nature of Services
The Company operates as a licensed tourism company offering attraction tickets and island activities in Langkawi. Some Products are fulfilled by partner venues or operators under the Company's coordination.
Images, descriptions, schedules, and inclusions displayed on the Platform are illustrative. Exact inclusions, operating hours, and access rules follow the Product terms and confirmation email.
The Company may substitute a Product with an equivalent experience of equal or higher value if the original becomes unavailable. If no suitable alternative exists, a refund will be offered according to the Refund Policy and the Product terms.
5. Booking Formation and Acceptance
A booking request submitted through the Platform does not constitute automatic acceptance. A booking becomes binding only upon all of the following:
- Successful payment verification.
- Issuance of a written booking confirmation by the Company via email or other electronic means.
The Company may reject, cancel, or modify any booking for suspected fraud, payment irregularities, pricing errors, Product unavailability, safety concerns, or operational limits. In such cases you will be notified and eligible payments refunded.
6. Pricing, Taxes, and Payment
All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of Sales and Service Tax (SST) where applicable, unless stated otherwise.
Prices may vary by season, visitor type, and availability. The Company may correct pricing errors before confirmation. Payment methods accepted are those shown at checkout.
7. Changes, Cancellations, and Refunds
Requests to change Visit Dates, guest counts, or Products must be made through support. Whether a change or refund is available depends on the purchased Product's terms and our Cancellation & Refund Policy.
Support-handled changes and refunds are processed by the Company on your behalf subject to partner and Product rules. No change is confirmed until you receive written confirmation from the Company.
8. Redemption and Visit Conduct
You must present your booking confirmation or reference at the attraction gate or meeting point. Late arrival to a timed session may result in denied entry without refund where Product terms require punctual attendance.
You must follow safety instructions, venue rules, and lawful directions of staff. The Company is not liable for denied entry caused by failure to meet Product eligibility or conduct rules.
9. Accounts and Communications
You are responsible for keeping account credentials secure. Transactional emails and WhatsApp messages about your booking form part of the service record.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, the Company is not liable for indirect, incidental, or consequential loss arising from use of the Platform or Products, except where liability cannot be excluded.
Partner-operated attractions remain responsible for on-site safety and operations according to their licences and Product terms.
11. Intellectual Property
All Platform content, branding, and materials remain the property of the Company or its licensors. You may not copy or redistribute them without written consent.
12. Governing Law
These Terms are governed by the laws of Malaysia. Disputes are subject to the exclusive jurisdiction of the courts of Malaysia.
